Assembly Bill 418 expands protection(s) for victims of domestic violence.

Gov. Jerry Brown on Monday, signed Assembly Bill 418 extending and expanding relief to victims of domestic violence, with respect to CA rental housing. The new bill allows for victims of domestic violence to terminate their lease early, without attaching proof of a filed police report and/or restraining/protective order to the written notice, as require under previous state law.

According to the new bill, this is accomplished by providing documentation from a “qualified third party based on information received by that third party while acting in his or her professional capacity to indicate that the tenant or household member is seeking assistance for physical or mental injuries or abuse resulting from an act of domestic violence, sexual assault, stalking, human trafficking, elder abuse, or dependent adult abuse.” This newly allowed form of supporting documentation, can be provided in lieu of a protective order or written police report.

The new provisions also decrease the victims obligation to pay, from 30 days to 14 days following lease termination.
